Terms and Conditions

  1. Booking Contract : These terms and conditions are between and shall bind the property owner or manager of “Bertra Strand Apartments”, Westport, Mayo (“we”, “us” and “our”) and the holidaymaker(s) (“you” and “your” members of your holiday party) who book “Croagh Patrick Apartment” / “Bertra Lodge” (the “Property”). This Booking Contract together with our booking confirmation email stating no. of guests, rental dates, quotes and due payments forms the basis of your agreement with us so please read them carefully. Payments of the nonrefundable booking deposit (payment 1) and payment of the balance + services fees (payment 2) in the agreed timeframe constitutes acceptance of these terms and conditions. You also agree to provide us with ID and addresses of guests in advance of your stay at the property and phone no. of the main contact guest.
  2. Limit of Liability : When booking “Croagh Patrick Apartment” / “Bertra Lodge” we assume and recommend that you and your other guests in your party have their own appropriate travel and health insurance to cover the full duration of their holiday rental as well as travel to and from the property. We will not be in breach of this Booking Contract, or otherwise liable for any failure or delay in performance, arising from any circumstances including, without limitation, Corona Virus (COVID-19) pandemic, flood, fire and smoke, explosion, flood, loss or damage to personal property and cars or personal injury or accident while on, inside or outside, the property. Our maximum liability for losses you suffer as a result of us acting in breach of this Booking Contract including any liability claims is strictly limited to the amounts received by us in relation to your Booking. We shall not be liable for any further losses or claims as a consequence of us breaching this Booking Contract. As your booking is made for the purpose of a holiday you acknowledge that we will not be liable for claims concerning any business losses.
  3. Complaints : We wish to ensure that you have an enjoyable and memorable holiday and we do take your personal safety and health seriously. If however, you have any cause for a reasonable complaint it is important that you notify us promptly so that remedial action can be taken as soon as possible. As hosts you have to give us the chance to rectify and resolve any such issue(s). Complaints must be made while in residence – as complaints, especially of a transient nature such as preparation and heating – cannot be investigated unless registered whilst you are still in residence at the Property. You agree to allow us or any representative of ours (such as a plumber or electrician) access to the Property at any reasonable time, by prior notification by phone or text, during your stay for the purpose of essential repairs, or in an emergency.
  4. Property Regulations : You and your party agree to comply with the regulations (see also 7. Guests and Pets policy) set out in the booking website and our property manual : – no pets or animals – no smoking inside – no parties or events – not suitable for young children or people with walking difficulties – no extra guests not booked – fire safety – check-in/check-out times
  5. Damage : You agree to keep and leave the Property and the furnishings, including items such as kitchen equipment, crockery and glasses clean and in good condition. You agree not to cause any damage to the walls, doors, windows or any other part of the Property. (We may at our discretion charge an agreed damage deposit which will be returned by PayPal at the end of the rental.)
  6. Personal Responsibility : You agree to take all necessary steps to safeguard your personal property while at the Property nor to do anything that may be reasonably considered to cause a nuisance or annoyance to us or to any other occupier of adjoining or neighbouring properties.
  7. Guests and Pets policy : You agree to ensure that each member of your party booked into “Croagh Patrick Apartment” / “Bertra Lodge” is covered by comprehensive travel insurance (including cancellation, flight delays, loss and damage to baggage and other property) and health insurance (including evacuation and repatriation coverage). You cannot allow more people to stay in the Property than expressly authorised, nor can you change the makeup of the party during your stay in the Property, nor can you take your pet into the Property unless permitted by us in writing in advance. If you do so, we can refuse to hand over the Property to you, or can require you to leave it. We will treat any of these circumstances as a cancellation of the Booking by you and we shall be under no obligation to refund you for any fees already paid to us in those circumstances. Any refund will be at our sole discretion.
  8. Cancellation and Refund Policy : As a individual holiday rental business we have to insist on a strict non-refundable booking deposit policy without exception and would ask guests to take out appropriate travel insurance to cover unforeseen extraneous circumstances. If you have fully paid (booking deposit + payment 2) for the booking and cancel in writing at least 7 days before your booking dates we will try to move your booking to another time if available. If not possible a refund of 50% of the 2. payment will be made (excl. booking deposit). However if your booking cancellation is less than 7 days before your booking arrival date or if you don’t arrive (no show) or leave early before the end of your booked period – we shall be entitled to treat your Booking as being cancelled by you and a no refund cancellation policy will apply. The same no refund cancellation policy applies if a booking is cancelled or voided a second time after being moved from earlier dates. If we have to close the Property for your booked holiday dates due to local Covid-19 lock-down travel restrictions or other extraneous circumstances we will promptly inform you and refund your payments and your booking deposit.
  9. Booking Deposit (non-refundable) or Payment 1 : € 350 for high season per 6/7 day bookings, € 300 for mid season per 6/7 day bookings and € 250 for low season per 6/7 day bookings.
  10. The balance of your booking payment (Payment 2) with fees has to be paid by the agreed timeframe of at least 30 days before the arrival date or the booking becomes void and the booking deposit will not be refunded. If you have fully paid for the booking and cancel in writing at least 7 days before your booking dates we will try to move your booking to another time if available. If not possible a refund of 50% of the 2. payment will be made (excl. booking deposit).   11. Law and Jurisdiction : This Booking Contract (including any non-contractual obligations arising under or in relation to this Booking Contract) between you and us is governed by the law of Ireland and we both agree that any dispute, matter or other issue which arises between us will be exclusively dealt with by the Courts of Co. Mayo.
  12. Miscellaneous : You may not transfer your Booking or any rights and responsibilities under this Booking Contract to any other person, without our prior written consent. If at any time any part of this Booking Contract is held to be unenforceable for any reason under any applicable law, that part shall be deemed omitted and the enforceability of the remaining parts shall not in any way be affected by that omission.This Booking Contract, together with the Cancellation Policy and our confirmation email contain the entire agreement between us and you relating to the Booking and shall supersede any previous agreements, arrangements or discussions between you and us, whether oral or in writing.
